Court jurisdiction
Within its jurisdiction specified by the Constitution
and Law, Cantonal Court in Livno exercises its judicial function for the
territory of Canton 10. The Court has five (5) judges.
Subject matter jurisdiction of the Cantonal Court in
Livno is determined by Article 28 of the Law on
Courts in the Federation of Bosnia and Herzegovina (“Official Gazette of
the Federation of Bosnia and Herzegovina”, no. 38/05, 22/06, 63/10, 72/10,
7/13, 52/14 and 85/21).
1) First-instance jurisdiction:
- for criminal offences for which more than 10
years of imprisonment or long-term imprisonment is prescribed, unless the
competence of another courts is prescribed by law;
- to proceed during the investigation and after the
bringing of the indictment, in accordance with law;
- to judge for criminal offences for which the
Court of Bosnia and Herzegovina transferred its jurisdiction to cantonal
courts and
- to decide on all administrative disputes, as well
as on requests for protection of freedoms and rights guaranteed by the
Constitution, if such freedoms and rights have been violated by a final
individual act or activity of an authorized person in an administrative
body, or an authorized person in a company, institution or other legal
entity, when other court protection for protection of those rights has not
been provided.
2) Second-instance jurisdiction:
- to decide on appeals against decisions of
municipal courts;
- to decide on appeals against decisions for minor
offences;
- to decide on other ordinary and extraordinary
legal remedies, if provided by law.
3) Other competencies:
- to decide on conflicts of territorial
jurisdiction among the municipal courts in its canton area;
- to decide on the transfer of territorial
jurisdiction from one municipal court to another in its canton area;
- to decide to expunge a conviction or to terminate
security measures and legal effects of a conviction based on the decision
of the court;
- to proceed upon requests for pardon, in
accordance with law;
- to decide on recognition of decisions of foreign
courts, foreign commercial courts and foreign arbitration;
- to provide international legal assistance in
criminal matters, and
- to perform other activities, as prescribed by
law.
Internal organisation and systematisation of posts of
the Cantonal Court in Livno is regulated by the Ordinance on internal
organisation adopted by the president of the court after the prior consent of
the Federal Ministry of Justice in Sarajevo.
The operations of the court are managed by the
President of the Court. The President has the rights, obligations and
responsibilities defined by the Law on Courts, the regulations governing the
internal operations of the court, rulebooks and other general acts.
In case of impediment or absence of the President of
the Court, s/he shall be substituted by the Vice-President of the Court.
